Console Makers and Tariff Refunds

Despite a generally soft consumer tech market, Sony and Microsoft are making console gaming look like the worse of two evils, even during a RAM shortage. Both companies have filed motions to dismiss class‑action lawsuits that accuse them of failing to pass on fee refunds, while some PC brands are moving in the opposite, pro‑consumer direction. In July, Sony said it expected to receive about $508 million in tariff refunds. Legal teams for both companies have asked a judge to dismiss the suits, arguing that paying the advertised price is not a legally cognizable harm and that any cost‑structure theory is speculative. If tariffs caused the price increases, they argue, prices would have fallen once the duties were removed, not risen again, avoiding any legal liability.

The backdrop is the US tariffs introduced last year, which raised import and tax rates on products made outside the United States. Those higher costs forced many manufacturers, including Sony and Microsoft, to raise prices on the PS5, Nintendo Switch and Xbox Series X|S. In July, Sony announced it expected to receive about $508 million in tariff refunds. Theoretically, that money should be returned to the consumers who paid the higher prices, not kept as extra profit.

Meanwhile, smaller companies are taking a different approach. Arctic, a PC‑building brand, pledged to pass its tariff refunds onto US customers through a limited‑time promotion, saying it feels the pain of consumers and wants to return every dollar of the refunded fees. Panic, maker of Playdate laptops, is also directly refunding customers who paid more during the tariff period.

These pro‑consumer moves are rare among industry leaders, and the lack of effort from Sony and Microsoft reflects poorly on their claim that console gaming is more consumer‑friendly. Sony has recently ended support for physical media, questioned the understanding of digital licensing among “unreasonable” consumers, and reminded PlayStation users of restrictive terms via email. The narrative that consoles are the more consumer‑oriented platform is fading.
